Women’s property rights incited by Supreme Court
New Delhi: It has been declared by the Supreme Court that a woman’s right on property, particularly instead of continuation to be rejoiced throughout duration of life, even after death can’t be depreciated & she is eligible to transfer her property as per her decision.
The Supreme Court decision makes it clear that even if the woman is detached from her husband, she has right to her “streedhan”. In 2005 the Supreme Court resolution permitted women a compeer allocation in bequeathed properly, althoughits consequences will come from that year ahead, it had elucidated currently.
A judiciary of justices MY Equal &C.Nagappan pronounced a women’s right over the property given for preservation is unquestionable & can.to be claimed after her death ,It also stated that it’s not only protocol to be practiced as an affair of adjustment but an irreplaceable right for the women which can’t be contradicted nudes Hindu Succession Act .
”It is well settled that under the Hindu law , the husband has got a personal obligation ,to maintain his wife & he is possessed of properties than his wife is entitled to a right to be maintained out of such properties .”
The succession has been proceeded on an appeal registered by a widow’s in-laws demanding her decision to grant the properties, given for her maintenance, to third party, But the appeal was refused by SC, as the relatives had had the view that the properties given to her to enjoy only during her lifetime & the possession must be bestowed with them after her death.
